SOFTWARE LICENSE AGREEMENT THIS AGREEMENT IS A LEGAL AGREEMENT BETWEEN YOU, THE END USER - EITHER AN INDIVIDUAL OR ENTITY - AND RELATIONAL ARTS CORPORATION PERTAINING TO THE USE OF IMPACT GEN SOFTWARE. BY USING THIS SOFTWARE, YOU AGREETO BE BOUND BY THE TERMS OF THIS AGREEMENT. Number of Licensed Users allowed hereunder: 1 SOFTWARE VERSION: IMPACT GEN version 1.1 Trial GRANT OF LICENSE: The Impact GEN software includes certain programs, libraries, database schema, and data developed by Relational Arts Corporation collectively called Impact GEN. This Software License Agreement ("License") grants you the right to use one copy of the specified version of the software product ("SOFTWARE") on any single computer or network server, provided the SOFTWARE is in use on only one computer at any time. If you have multiple Licenses for the SOFTWARE, then at any time you may have as many copies of the SOFTWARE in use as you have Licenses. The SOFTWARE is in use on a computer when it is loaded into the temporary memory (i.e. RAM) or permanent hardware memory (e.g. hard disk, CD-ROM, or other storage device) of that computer, except that a copy installed on a network server for the sole purpose of distribution to other computers is not "in use". This is a trial version of the SOFTWARE. It is offered as-is without expressed or implied warranty. You may use the SOFTWARE without cost to you at you own risk. COPYRIGHT: The SOFTWARE is owned by RELATIONAL ARTS CORPORATION and is protected by United States copyright laws and international treaty provisions. You must treat the SOFTWARE like other copyrighted material (e.g., artwork or a book) except that you may make one copy of the SOFTWARE solely for backup or archival purposes. You may not copy any written materials accompanying the SOFTWARE. LIMITED WARRANTY: RELATIONAL ARTS CORPORATION warrants that the SOFTWARE will perform substantially in accordance with the accompanying written materials for a period of ninety (90) days from the date of receipt. Any implied warranties on the SOFTWARE are limited to ninety (90) days. The entire liability of the purchase price and your exclusive remedy shall be repair or replacement of the SOFTWARE, provGENd that you notify within the ninety (90) days warranty period following purchase of the SOFTWARE, and provGENd that you are the original user of the SOFTWARE. This Limited Warranty gives you specific legal rights. You may have others, which vary from state to state. NO LIABILITY FOR CONSEQUENTIAL DAMAGES: In no event shall RELATIONAL ARTS CORPORATION or its suppliers be liable for any damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or other pecuniary loss) arising out of the use of, or inability to use this software product, even if RELATIONAL ARTS CORPORATION has been advised of the possibility of such damages.
