BY INSTALLING AND USING THE SCREENSAVER YOU ACKNOWLEDGE YOUR ACCEPTANCE AND AGREEMENT TO THE TERMS AND CONDITIONS OF THIS LICENCE AGREEMENT. SOFTWARE LICENCE AGREEMENT This screensaver is the property of Themestress Desktop Enhancements, the copyright owner. In consideration of payment of the Licence fee, being part of the total price of this product, Themestress Desktop Enhancements (the Licenser), permits you to use one copy of the software program on a single computer. It does not allow you to network the screensaver or use it on more than one computer at any one time. The Licenser does not transfer the ownership of the screensaver. If you fail to comply with any part of the agreement, your licence is automatically terminated. In addition, you are responsible for the selection of screensaver suitable for the achievement of your intended results and for the installation and use of the software. 1. COPYRIGHT The software is owned by Themestress Desktop Enhancements and grants the original purchaser: a) the right to make one copy of the software for backup or archival purposes only and b) to transfer the software to a single computer so long as the original software is retained solely for backup or archival purposes only. You are not allowed to copy the screensaver in any other circumstances, or copy any written materials provided with the screensaver. Unauthorised copying of the software is expressly forbidden. You will be held legally responsible for any infringement of copyright that is a result of your failure to ensure that all conditions of this Licence are adhered to. 2. OTHER RESTRICTIONS You are not allowed to rent or lease the screensaver to any third party. You may not copy, modify or transfer the software in whole or in part, neither are you allowed to incorporate in part or in whole any section of the software in any other software programs. Any documentation provided with the software is restricted to the same conditions as the software. 3. TERMINATION This Licence agreement will be terminated automatically by non compliance with any terms within this agreement. In the event of termination all originals and copies of the software, documentation and other materials must be returned to Themestress Desktop Enhancements at the Licensee's expense. The Licensee will also eradicate and prove that Themestress Desktop Enhancements and associated programs and databases have been eradicated from the Licensee's computer system. Themestress Desktop Enhancements will be entitled to terminate this agreement forthwith and without notice to the Licensee in any of the following events: a. If the Licensee shall be in breach of any obligations hereunder. b. If the Licensee being an individual should commit an act of bankruptcy or being a company shall enter into liquidation or enter into a winding up resolution, whether voluntarily or compulsory, other than a voluntary liquidation for the purpose of reconstruction or amalgamation. c. An administration order is made in relation to the Licensee, a receiver is appointed over, or an encumbrance takes possession of or sells any of its assets. d. The Licensee's dissolution, merger, consolidation or change of ownership, or transfer of a substantial part of its property, whether or not by operation of law. Termination by the Licensee or the Licenser of this agreement will not entitle the Licensee to any prorata refund of the licence fee. If the Licensee intentionally amends or changes the subject software, the agreement will be deemed terminated by the Licensee. 4. DISCLAIMER By installing and using Themestress Desktop Enhancements, the User, acknowledge your acceptance of the terms and conditions of the Software Licence Agreement. Themestress Desktop Enhancements cannot be held responsible in any way whatsoever for the Users actions nor the output or results of the use of Themestress Desktop Enhancements.
